The case was tried to verdict in DeKalb County State Court, resulting in a jury verdict of $3,862,000.
$3,826,000 – Traumatic Brain Injury Caused By Vehicular Accident
After a three-day trial, a Fulton County Jury compensated our client $3,826,172.26. Our client was the passenger in a vehicle driven by her friend in the early morning hours of September 1, 2008. The driver fell asleep and caused the vehicle to crash into the median wall leaving the vehicle disabled in the emergency lane and partially blocking the far left lane of the highway. Fifteen minutes after the initial impact, an employee of defendant Phoenix Air Group came along at a high rate of speed while following another vehicle too closely and slammed into the disabled vehicle. By then the two women had exited the disabled vehicle and were standing with a good samaritan 4 to 5 car lengths away when the defendant’s employee struck the disabled vehicle and sent it careening into the two women and the good samaritans. Our client was left unconscious and bleeding at the side of the highway. She suffered a traumatic brain injury and was ultimately diagnosed with a permanent brain injury. State Farm Insurance offered only $5,000 to resolve the case before trial.

Our minor client suffered a traumatic brain injury when struck by an automobile as she attempted to cross the street. Although the driver had state minimum limits of insurance, our investigation showed that the driver was making a food delivery at the time of the accident and that out-of-state corporate defendants were responsible for the driver.
